Macaws.ai provides an AI-powered telephone receptionist service that answers incoming calls on behalf of your business, takes messages, books appointments, and integrates with your existing tools. The specific features available to you depend on your chosen subscription plan.
We reserve the right to modify, update, or discontinue any feature of the Service at any time. Where material changes affect your paid plan, we will give you at least 30 days' notice.
To use the Service you must create an account and provide accurate, current, and complete information. You are responsible for:
You must be at least 18 years old and authorised to enter into a binding contract to use the Service.
The Service is offered on a subscription basis. Fees are charged in advance on a monthly or annual basis depending on your chosen plan. All prices are shown inclusive or exclusive of VAT as indicated at checkout.
Payment is processed via our third-party payment provider. By providing payment details, you authorise us to charge the applicable fees on each billing cycle.
If a payment fails, we will notify you and attempt to retry. If payment remains outstanding after 7 days, we may suspend your account until the balance is settled.
Subscription fees are non-refundable except where required by applicable law or as otherwise agreed in writing. If you cancel, you will retain access until the end of your current billing period.
We may change our pricing with 30 days' notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.

As the business deploying the AI receptionist, you are responsible for:
All intellectual property rights in the Service, including its software, algorithms, branding, and documentation, belong to FairFax Group Ltd (trading as Macaws.ai). Nothing in these Terms transfers any ownership of our IP to you.
You retain ownership of your Content. By using the Service, you grant us a limited, non-exclusive licence to process your Content solely to provide and improve the Service.
Our collection and use of personal data is governed by our Privacy Policy. Where we process personal data on your behalf (as a data processor), the terms of our Data Processing Addendum apply, which forms part of these Terms.
You agree to use the Service in compliance with the UK GDPR and all applicable data protection laws.
Each party agrees to keep confidential any non-public information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential. This obligation does not apply to information that is publicly available or independently developed.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that every call will be answered perfectly. AI responses may occasionally be inaccurate; you should review call logs and maintain appropriate human oversight.
To the fullest extent permitted by applicable law, FairFax Group Ltd's (trading as Macaws.ai) total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.
We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of business, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.
You agree to indemnify and hold harmless FairFax Group Ltd (trading as Macaws.ai) and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.
These Terms remain in effect for as long as you have an active account. Either party may terminate at any time:
Upon termination, your access to the Service will cease. We will retain your data in accordance with our Privacy Policy and provide an export upon request within 30 days of termination.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before commencing legal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct negotiation for at least 30 days.
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect via email or a prominent notice on our website. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
